The instant bail application has been filed seeking release of the applicant on bail in Case Crime No. 337 of 2024, under Sections 191(3), 103(1), 3(5), 131 B.N.S., Police Station Rajghat, District Gorakhpur during pendency of the trial. 3. FIR of the present case was lodged on 13.10.2024 at 17.15 hours against applicant and four others and according to the FIR on 12.10.2024 applicant and three others caught hold the nephew of the informant and thereafter co-accused Vikash Nishad by inflicting knife injury committed his murder. It is further mentioned in the FIR that incident has been witnessed by Vishal Nishad S/o Rudal Nishad, Roshan Nishad S/o Janardan Nishad and Nitesh Nishad S/o Pradeep Nishad. 4. Learned counsel for the applicant submits, however, applicant is named in the FIR but ev
