Learned A.G.A. has informed that notice to the informant has been served on 23.3.2025. 3. Heard Sri Pushpendra Vishwakarma, Advocate holding brief of Sri Keshari Nath Tripathi, learned counsel for the applicant, Sri Sushil Kumar Shukla, learned State Law Officer and perused the material placed on record. 4. Applicant seeks bail in Case Crime No.757 of 2024, under Sections 137(2), 65(1) B.N.S. and 4(2) POCSO Act, Police Station- Civil Lines, District- Moradabad, during the pendency of trial. 5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The statement of the victim recorded U/s 183 B.N.S.S. cannot be relied upon as it is self-contradictory. The FIR itself is delayed by about eleven hours and there is no explanation of the said delay caused. The victim is a consenting party. 6
