The present criminal appeal has arisen from judgment and order dated 28.09.2002 passed by Sri Shashank Shekhar, Additional Sessions Judge, Room No.18, Allahabad in Sessions Trial No.430 of 1999 (State Vs. Sunder Lal), under Section 376 IPC, arising from Case Crime No.179 of 1998, P.S. Shankergarh, District Prayagraj, convicting the accused appellant and sentencing him to undergo life imprisonment for the offence under Section 376 IPC and to pay fine Rs. 50,000/- and in default of payment of fine to undergo further additional rigorous imprisonment of one year of the amount of fine deposited, Rs.20,000/- was directed to be given to the victim. 3.
