On perusal of the record, we find that appeal in respect of appellant no. 1 (Nazaruddin) stood abated pursuant to the order dated 10.05.2022. The appellant no. 2 (Jagat Singh) as per report of the Chief Judicial Magistrate, Amroha dated 07.02.2022 has died about 16 years back. The photo copy of death certificate of Jagat Singh on record reflects that he died on 27.08.2004. However, it appears that vide order dated 31.01.2024, the leave to continue the appeal filed alongwith delay condonation application No. 2 of 2022 was allowed and that is how the learned counsel for the appellant no. 2 representing his legal heir Akhilesh Kumar Kardham is present before us and has argued the appeal. 3.
