The present petition has been preferred under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, assailing the impugned order dated 28.01.2025 (Annexure P-1), whereby the learned Judicial Magistrate Ist Class, Gurugram has declared the petitioner a proclaimed person. 2. Learned counsel for the petitioner submits that a complaint was filed on 14.06.2018 under Section 138 of the Negotiable Instruments Act against the petitioner. He submits that the petitioner was granted concession of bail vide order dated 02.12.2019 and was regularly appearing before the learned Trial Court. He submits that the respondent had filed another complaint against the petitioner, however, the same was ordered as ‘dismissed in default’ vide order dated 21.03.2023 due to non- appearance of the complainant party.
