The appellant filed a criminal complaint under Section 138 of the Negotiable Instruments Act, 1881 read with Section 420 IPC against the respondent in the Court of the Magistrate concerned at Jagadhari. Amount of cheque involved in the said complaint was Rs.8,50,000/- (Rupees Eight Lakhs Fifty Thousand Only). The allegations in it were that the said cheque was issued for discharge of a legally enforceable liability but when it was presented for encashment, it was dishonoured compelling the complainant to issue the statutory notice under the said Section and for non-compliance of the said notice, to file the said complaint. 2.
