JUSTICE PARMOD GOYAL Present: Mr. Gurvinder Arora, Advocate, for cross-objector/respondent No.7. PARMOD GOYAL, J. (Oral) Present cross objections are pending as they were preferred by respondent No.7 in RSA-2991-2005 filed during pendency of said RSA. The said RSA was withdrawn by appellant Bhupinder Kaur. 2. Now, learned counsel for respondent No.7-Cross Objector wants to withdraw present cross objections with permission to prefer fresh suit seeking his claim on the basis of Will and adverse possession. Admittedly, the Will was subject matter of another litigation with the brothers of Testator-Makhan Singh wherein as per respondent No.7, Will was not pleaded. 3. Accordingly, present cross objections are dismissed as withdrawn. It is made clear that cross objector-respondent No.7 shall be at liberty to take legal recourse in accordance with law subject to all defences of limitation etc. available to other party.
