Osmany Court No. - 1 HON'BLE RAJAN ROY, J. HON'BLE ABDHESH KUMAR CHAUDHARY, J. (C. M. Application No. 32528 of 2006) 1. This is an application for condonation of delay in filing special appeal. 2. The special appeal was filed in 2006 by the State of U.P. challenging the judgment and order dated 11.11.2005, however, the appeal itself was filed on 11.09.2006 with a delay of about 8 months 21 days. 3. We have gone through the affidavit filed in support of the application for condonation of delay and do not find the explanation to be satisfactory. We accordingly reject the application for condonation of delay in filing special appeal. 4. Consequently, the special appeal also stands dismissed. (Abdhesh Kumar Chaudhary,J.) (Rajan Roy,J.)
