As per order dated 25th February 2026, appellant No. 1, Udai Raj had passed away and therefore appeal in respect of him stood abated. The appeal is therefore being heard with regard to appellant No. 2, Jagdish. 3. The instant Criminal Appeal under Section 374(2) Cr.P.C. has been filed against judgment and order dated 25th October, 2008 passed by Additional Session Judge/ Special Judge E. C. Act/Court No. 9 Sultanpur in Sessions Trial No. 82/2005, State v. Udai Raj and another, arising out of Case Crime No. 455 of 2004, under Section 323/504/304 I.P.C., Police Station Peeparpur District Peeparpur convicting and sentencing the appellant as under:- (i) under Section 323/34 I.P.C. to one year imprisonment (ii) under Section 304/34 I.P.C. to five years rigorous imprisonment and a fine of Rs.5,000/- each a
