The instant Criminal Appeal under Section 374(2) CrPC has been filed against judgment and order dated 16.05.2007 passed by Additional Sessions Judge/ F.T.C. No.1, Hardoi in Sessions Trial No.162 of 2001, State v. Ram Singh & Ors. arising out of Case Crime No. 30 0f 2000, under Sections 307, 504, 506 I.P.C., Police Station Sandi, District Hardoi, convicting and sentencing the appellant as under:- (i) under Section 307 I.P.C. to five years rigorous imprisonment and a fine of Rs.1,000/- and in default of fine, six months additional imprisonment 3. As per prosecution version, incident is said to have taken place on 10.03.2000, when the appellant and co-accused are said to have attacked the son and nephew of the informant due to dispute over agriculture property.
