Present application has been filed under Section 528 BNSS challenging the notice dated 05.01.2026 issued by respondent no.2 (Annexure No.1) in purported exercise of power under Section 35(3) of BNSS in pursuance to a complaint made by respondent no.4, and the consequential notices. 2. Shri Manish Tiwari, learned Senior Advocate appearing for the applicants has strenuously argued that the entire proceedings initiated at the behest of respondent no.4 are nothing but an abuse of process of law and respondent no.4 has unfortunately taken recourse of criminal prosecution in respect of claims which are essentially civil in nature.
