Learned counsel refers to the Instructions dated 21.05.1973, relied upon in the impugned order dated 25.11.2020, Annexure P-8, which are not applicable inasmuch as it requires the annual confidential reports for at least 10 years to be taken into consideration and does not relate to the punishment awarded to an employee. In fact, Instructions dated 31.05.2006, Annexure P-12, based on the judgment of Hon’ble the Supreme Court in State of Tamil Nadu vs. Thiru K.S.Murugesan, 1995(3) RSJ 27, apply wherein it has been mentioned that no promotion is to be allowed during the currency of punishment of stoppage of increment, which in case of the petitioner was over in July, 2018 and as such in the year 2019-20, he could not have been ignored for promotion. He, thus, prays that his case be re-considered
