DEEPAK GUPTA, J.(Oral) In a suit for specific performance filed by the peoner, a er closure of the evidence of both the pares, plainff-peoner had moved an applicaon (Annexure P-2) for ge(ng compared the signatures of defendant No.2 from the handwring expert. Said applicaon has been dismissed by the trial Court vide impugned order dated 09.07.2026 (Annexure P-1), which is assailed before this Court. 2. On query, learned counsel for the peoner concedes that no applicaon was moved for permi(ng the peoner to produce addional evidence. Upon this, learned counsel for the peoner has made statement so as to withdraw this peon with liberty to file fresh applicaon before the concerned trial Court for producon of addional evidence. 3.
