This petition has been filed under Section 528 of BNSS, 2023 (corresponding Section 401 Cr.P.C.) seeking quashing of the impugned order dated 22.12.2023 in CRA-206-2023 titled as ‘Rajpal vs. The Rewari Central Cooperative Bank Ltd.’ passed by the learned Additional Sessions Judge, Rewari whereby the petitioner has been directed to deposit 20% of compensation amount while suspending his sentence. 2. Learned counsel for the petitioner submits that the condition of depositing 20% of the amount awarded by the learned Appellate Court for suspending the sentence of the petitioner is not compliable as the petitioner is currently facing financial hardship and is not in a position to pay/deposit the said amount. 3.
