Prayer in this petition has been made for issuance of direction to the learned trial Magistrate to modify the order dated 04.04.2026 passed by him/her in case arising out of FIR No.139, dated 01.11.2018, registered under Section 61 of the Excise Act, at Police Station Chabbewali, District Hoshiarpur, whereby the prayer made by the petitioner for refund of surety amount though allowed but it was not ordered to be released in favour of his special power of attorney holder. 2. Learned counsel for the petitioner has brought the attention of this Court to Annexure P-2, which is a copy of order dated 04.04.2026 passed by learned trial Magistrate, showing that the refund voucher qua an amount of Rs.50,000/-, which had already been deposited as surety amount by the petitioner, had been ordered to be issued in his favour.
