Prayer made in the present petition is for quashing the order dated 04.02.2004 whereby respondents have been assigned deemed date of promotion, might not be surviving due to efflux of time especially in wake of there being no interim order. 2. Learned State counsel, on the other hand, submits that petitioners were not promoted along with the others on account of they having not passed the type test, however, having been done so on 22.08.2005, they were accordingly promoted. 3. Disposed of, reserving the petitioners with a liberty to get it revived by demonstrating that cause of action still subsists.
