## Judgment text (excerpt)

SARITA RANI 2026.07.15 17:16 I attest to the accuracy of this document/order FAO No.2113 of 2023 (O&M) 2026:PHHC: 095663 FAO No.2832 of 2023 (O&M) including the vakalatnama, to their counsel before the Tribunal, namely Sh. Shahjad Hussain, Advocate, with instrucons to file appeals. It is pleaded that the said counsel failed to instute the appeals and subsequently expired on 11.10.2022. According to the appellants, they remained unaware of both the demise of their counsel and the fact that no appeals had been filed unl January, 2023. Therea)er, they engaged the present counsel, who filed the present appeals. 4. Having given though+ul consideraon to the submissions advanced by learned counsel for the appellants, this Court is unable to accept the explanaon as constung "sufficient cause" within the meaning of Secon 5 of the Limitaon Act. 5. It is trite that while the expression "sufficient cause" is to receive a liberal construcon so as to advance substanal jusce, parcularly where refusal to condone delay may result in denial of adjudicaon on merits, the applicant is nevertheless required to furnish a bona fide and sasfactory explanaon accounng for the enre period of delay.
