The appellant through instant appeal under Section 58 of the Real Estate (Regulation and Development) Act, 2016 (for short ‘2016 Act’) is seeking setting aside of order dated 03.02.2025 whereby learned Haryana Real Estate Appellate Tribunal, Chandigarh (for short ‘Tribunal’) has dismissed its application seeking waiver from making pre-deposit. It is also seeking setting aside of order dated 06.04.2026 whereby Tribunal has dismissed the application for revival of appeal. 2. Learned counsel for the appellant submits that by impugned order Tribunal has dismissed its application seeking restoration of appeal and adjudication on merit on the sole ground that appeal stands dismissed on account of non-compliance of condition of pre-deposit and Tribunal cannot restore appeal.
