Instant petition has been filed under Section 528 of BNSS, seeking quashing of order dated 09.03.2026, passed by learned SDJM, Pataudi, District Court, Gurugram, in CIS No.COMA 13/2025 (Annexure P- 1), and all consequential proceedings arising therefrom. 2. Petition at hand has been filed for seeking quashing of the pre- summoning notice issued to the petitioner. In fact, by filing the present petition, petitioner has completely disregarded the statutory opportunity given to the named accused in the complaint case proceedings before taking cognizance in the case. In fact, proviso to Section 223 of the Bharatiya Nagarik Suraksha Sanhita, 2023, mandates that before taking cognizance in the complaint
