The petitioner was given adverse remarks for the years 01.04.2000 till 31.03.2001 on account of there being an FIR No.236 of 2000 wherein untraced report was filed and as such, criminal proceedings were dropped and consequently, discharged. The departmental inquiry was held not proved by the Enquiry Officer, in wake of which, the adverse remarks were expunged by the Division Bench of this Court in CWP-1223-2007 filed by the petitioner allowing the same vide judgment dated 25.04.2007. 2. Likewise, for the years 01.04.2001 till 31.12.2001, adverse remarks were again recorded on the basis of above FIR as also FIR No.452 of 2001 wherein he was acquitted vide judgment dated 13.03.2008, Annexure P2, and exonerated in the departmental inquiry, Annexure P3. 3.
