The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking appropriate directions to respondent Nos. 4 and 5 not to harass the petitioners or falsely implicate them at the instance of the private respondent. A further direction is sought that, if the petitioners are required in connection with any enquiry or investigation, they be served with prior notice under Section 35(3) of the BNSS, 2023. 2. Learned counsel for the petitioners submits that respondents No. 4 and 5, at the instance of the private respondent, are repeatedly summoning the petitioners to the police station on the pretext of conducting an enquiry and are threatening to falsely implicate them in criminal cases with a view to coercing them into withdrawing the legal proceedings initiated by them.
