Heard Sri Hasan Parvej Advocate holding brief of Sri Ramajan Ahmad, learned counsel for the applicant and Sri Manoj Kumar, learned Brief Holder for the State- respondent. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 42 of 2026, under Sections 103(1), 238 BNS, Police Station Ghazipur, District Fathepur, during pendency of the trial in the court below. 3. Learned counsel for the applicant submitted that nobody was named in the FIR and FIR of the present case was lodged by one Asharam with regard to a dead body which was lying in the field but subsequently it was revealed that dead body was of the daughter of the applicant and thereafter Investigating Officer recorded the statement of one Rajendra Kumar who stated that in the night of first March, 2026 he witnessed that applicant alongwith his son Afsar was going alongwith deceased and only on the basis of
