(ORAL) Petitioner Balkar Singh through his power of attorney holder Nishan Singh filed petition under Article 227 of the Constitution of India for setting aside the order dated 20.04.2026 (Annexure P-3) passed by learned Civil Judge (Senior Division), Tarn Taran whereby application under Order 26 Rule 9 CPC (Annexure P-1) filed by petitioner has been dismissed. During the course of arguments, power of attorney holder of petitioner confirmed that Gulwinder Singh has filed suit for possession along with relief of permanent injunction against Nishan Singh and others (Annexure P-5). At present, case is pending for plaintiff’s evidence and the recording of plaintiff’s evidence is yet to start and the next date fixed in this case is 21.07.2026.
