The petitioner has preferred present writ petition inter-alia with the following prayers :- "a) issue a writ, order or direction in the nature of MANDAMUS directing to the respondent no. 2 and 3 both to remove the encroachment made by the respondent no. 4 over the Gata No. 294 (Banjar land) situated in Village Laxmipur Ekdanga, Tehsil Sadar, District Maharajganj under Section 67 (1) of U.P. Revenue Code, 2006 expeditiously, or within the period fixed by this Hon'ble Court for the same." 2. A preliminary objection has been raised by Sri Vijay Shankar Prasad, learned Additional Chief Standing Counsel that the present writ petition has been filed by the Pradhan of the Village but by a private counsel, which is not permissible in law hence same is not maintainable. 3.
