Heard learned counsel for the petitioner. 2. The petitioner has preferred the present petition inter alia with the prayer to direct the Respondent No.7 namely Sub-Divisional Officer, Sadar, District Moradabad to decide the Execution Application dated 08.07.2025 filed by the petitioner in Suit No.3434 of 2023, in accordance with U.P. Revenue Code, 2006, in accordance with the judgment dated 19.05.2023 passed in the matter of Daya Shanker Versus State of U.P. reported in 2023 (6) ADJ 181, within stipulated period. 3. It is argued that the execution application is pending consideration, but till date no decision has been taken, hence the present writ petition. 4. Learned counsel for the petitioner placed reliance upon a judgement of the Supreme Court in the case of Rahul S. Shah Vs. Jinendra Kumar Gandhi and Ors reported in AIR 2021 SC 2161. 5.
