The present petition has been filed under Section 11 of the Arbitration and Conciliation Act, 1996 [“Act”], seeking the appointment of an Arbitrator in terms of the Compromise Deed dated 21.12.2017 [“Agreement”] on the ground that certain disputes have arisen inter se the parties in accordance with Clause 11 of the Agreement. Clause 11 of the Agreement reads as follows: “11. That, in case of any dispute/differences between the parties hereto and the relation to this compromise agreement, the same shall be referred to the sole arbitration of Advocate Sh. Rajeev Kapoor office :-X-1/101-107, WHS., Naraina New Delhi -28 and Advocate Sh. Arun Garg Delhi, whose decision award shall be final and binding on the party(s).” 2.
