Heard Shri Shiv Pal Singh, the learned counsel for the petitioner and Shri Ashish Saxena, the learned Standing Counsel for the State. 2. By means of the instant petition filed in public interest, the petitioner has sought issuance of a direction to the District Magistrate, Raebareli and S.D.M. Maharajganj, Raebareli to restrain the opposite party Nos.6 from raising construction over the main road of village-Kotwa, Police Sttation- Shivgarh, Raebareli and to take appropriate action against private opposite party for having made encroachment over the public land. 3. On the basis of written instructions provided by S.D.M., Maharajganj, Raebareli, the learned Standing Counsel has informed that the opposite party No.6-Siya Ram has constructed a house besides the road leading to the village.
