Learned counsel for the applicant submits that in the F.I.R. the victim alleges that in the night of 06.11.2025 when she was sleeping in her house the applicant entered into her house and committed her rape while threatening and when she made noise on seeing some people the applicant fled away from there. In her statement recorded under Section 180 BNSS the victim states that after divorce with her husband, her affair developed with the applicant and they both had thought about marriage but the applicant had solemnize marriage with another woman six months earlier, on account of which they get separated from each other, previous day he entered into her house and committed her rape.
