Shri Rishabh Kapoor, learned counsel for appellant says that the Special Appeal no. 519 of 2023 has been inadvertently filed as the respondent is not an employee of the U.P Jal Nigam (Urban), but is an employee of U.P Jal Nigam (Rural), therefore, the said appeal be allowed to be dismissed as withdrawn. 2. The request is accepted. 3. The appeal is dismissed as withdrawn, without prejudice to the rights of the actual employer to challenge the same, if it is otherwise permissible in law.
