Heard learned counsel for the petitioner as well as learned A.G.A. for the State respondents. 2. The instant writ petition has been filed by the petitioner with the prayer to quash the impugned First Information Report dated 03.10.2025, registered as Case Crime No. 461 of 2025, under Section 125 BNS, Police Station Kithor, District -Meerut and for a direction to the respondents concerned not to arrest the petitioner in pursuance of impugned First Information Report. 3. Learned counsel appearing on behalf of the petitioner has submitted that all alleged offences are punishable with imprisonment upto seven years, therefore the police authorities are bound to follow the procedure laid down under Section 35(3) BNSS (41-A Cr.P.C).
