HON'BLE LAKSHMI KANT SHUKLA, J. 1. Heard learned counsel for the petitioners as well as learned A.G.A. for the State respondents. 2. The instant writ petition has been filed by the petitioners with the prayer to quash the impugned First Information Report dated 03,08.2024, registered as Case Crime No. 150 of 2025, under Sections 85. 115(2), 74, 351(2) of BNS and section 3/4 D.P. Act, Police Station Dehligate, District - Meerut and for a direction to the respondents not to arrest the petitioners in pursuance of impugned First Information Report. 3. Learned counsel appearing on behalf of the petitioners has submitted that all alleged offences are punishable with imprisonment upto seven years, therefore the police authorities are bound to follow the procedure laid down under Section 35(3) BNSS (41-A Cr.P.C).
