Heard Sri Surendra Narayan Mishra, learned counsel for the applicant, Shri R.K. Nishad, learned counsel holding brief of learned A.G.A. for the State and perused the record of the case. 3. The present bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of applicant, Naushad with a prayer to release him on bail in Case Crime No. 386 of 2025, under Section 8/21/29 of Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station- Gangoh, District- Saharanpur. 4. Learned counsel for the applicant has contended that 102 gm of smack is alleged to have been recovered from the possession of the applicant. In fact no such recovery was effected from the applicant.
