This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of the accused-applicant seeking enlargement on bail in Case Crime No. 260 of 2020, under Sections 3/25/27 of Arms Act, Police Station Chaubeypur, District Kanpur Nagar. Learned counsel for the applicant argued that the accused-applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 21.08.2020. He submits that the Investigating Officer has prepared a false recovery memo and shown recovery of one Tamancha of 315 Bore, 2 empty cartridge and one live cartridge from the possession of the applicant.
