Heard Sri Shiv Sharan Singh, the learned counsel for the petitioner and Sri Anil Kumar Kishwaha, the learned counsel for the State of U.P., Sri Farhan Habib, the learned counsel for the opposite party no. 2-U.P. Sunni Central Waqf Board. 2. By means of the instant petition filed in public interest, the petitioner has sought a direction to the opposite parties no. 2 & 3 to remove encroachment made over graveyard land. 3. The land is recorded in the name of a Waqf and the Waqf or its Mutwalli has not come forward. 4. Accordingly, the instant petition is dismissed leaving it open to the Waqf to initiate proceedings for removal of the encroachment. (Subhash Vidyarthi,J.)
