BAIL APPLICATION No. - 35178 of 2024 Applicant :- Vishal Malviya Opposite Party :- State Of Up And 3 Others Counsel for Applicant :- Rakesh Yadav Counsel for Opposite Party :- G.A. Hon'ble Siddharth,J. Heard learned counsel for the applicant and learned A.G.A for the State. There are allegations against the applicant of abduction of minor girl with intent to marry and commission of offence of penetrative sexual assault. Counsel for the applicant submits that the victim is although minor but she eloped with the applicant and went to Madhya Pradesh, Kanpur, Bhopal, etc. She has not made clear allegation of rape against the applicant. The applicant alleges false implication in this case. He is in jail since 17.05.2024 and has no criminal history to his credit. On the other hand learned A.G.A has opposed the prayer for bail.
