Heard Sri Abhay Raj Singh, learned counsel for the applicant and Sri Shatrughan Yadav, learned AGA for the State-respondent. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 173 of 2023, under Sections 302/34, 323/34, 325/34, 504/34 IPC, Police Station Ughaiti, District Budaun, during pendency of the trial in the court below. 3. Learned counsel for the applicant submitted that however, applicant was named in the FIR alongwith others including co- accused Rishipal but during investigation their involvements in the present case were found false and no charge sheet was filed against them and they have been summoned in the present matter under section 319 Cr.P.C. during trial and after considering entire facts of the case, co-accused Rishipal has been released on bail by this Court and his bail order has been annexed as annexure-9 to the affidavit and on facts, case of a
