Heard Sri Pradeep Kumar Rai, learned counsel for the applicant and Sri Santosh Nigam, learned AGA for the State. 2. The instant bail application has been filed seeking release of the applicant on bail in Case Crime No. 532 of 2024, under Sections 103(1), 3(5), 61(2) B.N.S., Police Station Bhelupur, District Varanasi during pendency of the trial. 3. Learned counsel for the applicant submits, however, applicant is named in the FIR along with others but on the basis of false allegation he has been made accused in the present matter. He further submits, even informant of the case was not an eye witness. 4. He further submits, during investigation Investigating Officer recorded the statement of one eye witness Sonu Vishwakarma and according to him co-accused Vishal Sonkar caused firearm injury to the deceased. 5.
