Counsel for Applicant :- Vipin Gangwar Counsel for Opposite Party :- G.A. Hon'ble Ashutosh Srivastava,J. Heard Sri Vipin Gangwar, learned counsel for the applicant, Sri Ajay Singh, learned Additional Government Advocate for the State and perused the record. The present bail application has been filed by accused- applicant- Amir Husain seeking bail in Case Crime No. 29 of 2025 under Sections 8/18/21/29/60 of NDPS Act, Police Station- Bhamaura, District- Bareilly. In the prosecution case it is alleged that during police checking, the police arrested the applicant and other co-accused persons. From joint possession of the applicant and co-accused, 4 kg opium/afim, 120 gm smack is alleged to have been recovered. The recovery has been made in front of the Gazetted Officer. Learned counsel for the applicant submits that the recovered quantity of contraband is 'below commercial quantity' as provided in the Schedule appended with the NDPS Act and therefore, the stringent conditions as contained in Section 37 of the N.D.P.S
