Heard Shri Rajrshi Gupta along with Sri Ayyaz Khan, learned counsel for the applicant, Sri Rajesh Kumar Singh, learned AGA for the State-respondents and perused the record. This bail application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been moved on behalf of accused- applicant, Arshad, seeking enlargement on bail in Case Crime No. 50 of 2023, under Sections 307, 452, 506 of I.P.C. and Section 3/25 of Arms Act, Police Station- Kankarkhera, District- Meerut. Learned counsel for the applicant argued that the accused- applicant is innocent. He has been falsely implicated in this very case crime number and is languishing in jail since 23.01.2023. Learned counsel for the applicant submits that only one witness i.e. P.W.1 (mother of injured) has been examined till now before the court below.
