Learned A.G.A. has informed that notice to the informant has been served on 23.8.2024. 3. Heard Sri Suhel Akhtar, learned counsel for the applicant as well as Sri J.K. Chaurasia, learned State Law Officer and perused the material placed on record. 4. Applicant seeks bail in Case Crime No. 195 of 2024, under Sections 65(2) B.N.S., 2023 and 5M/6 POCSO Act, Police Station Kotwali, District Gorakhpur, during the pendency of trial. 5. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. The informant has been examined during trial as PW- 1 and he has not supported the prosecution story and has completely resiled from his earlier statement and has been cross- examined by the public prosecutor after declaring him hostile.
