Counsel for Applicant :- Vinod Kumar Yadav Counsel for Opposite Party :- Chandra Kumar Rai,G.A. Hon'ble Ajay Bhanot,J. Matter is taken up in the revised call. By means of the bail application the applicant has prayed to be enlarged on bail in Case Crime No.386 2024 at Police Station-Bilariyaganj, District-Azamgarh under Sections 3(5), 109, 115(2), 351(2), 352, 103 of the B.N.S. and Sections 4/25 of the Arms Act. The applicant is in jail since 02.11.2024. The bail application of the applicant was rejected by trial court on 23.12.2024. The applicant has been identified as one of the principal offenders who stormed into the house of the deceased and attacked the latter and his family members. The post mortem report discloses a number of grievous injuries to the deceased which indicate the brutality of the assault. The applicant shared the common intent with other accused to commit the offence. There are eye witnesses to the incident. The weapon of assault has been recovered from the applicant.
