Heard learned Counsel for the applicant and Sri V.P.Tripathi, learned A.G.A. for the State and perused the record. 2. The instant bail application has been filed with a prayer to enlarge the applicant on bail in Case Crime No. 330 of 2024, under Sections 303(2), 317(2), 317(5), 318(4), 338, 336(3) BNS, Section 60/63 of U.P. Excise Act and Section 4/25 Arms Act, Police Station- Rifinary, District- Mathura, during pendency of the trial. 3. Counsel for the applicant submits that the applicant has been falsely implicated in the instant case. False recovery of a Tata Harrier Car and 10 boxes of illicit liqure (total 500 quarters) has been shown. There is no independent witness to the alleged recovery. The co-accused Amitesh @ Monu has been granted bail by this Court vide order dated 03.06.2025 passed in Criminal Misc. Bail Application No. 5895 of 2025. The applicant claims parity.
