The petition has been filed alleging illegal encroachment made by respondent nos. 6 to 9 over land of 'Rasta' of Gata No. 222 situated in Ward No. 1 Maharshi Balmiki Nagar, Nagar Panchayat Badhani Chafa, P.S. Bhawaniganj, Tehsil - Dumariyaganj, District - Siddharth Nagar. 2. Submission has been made that respondent nos. 6 to 9 have encroached on the land in question by constructing house over the said land. 3. Learned counsel appearing for Nagar Panchayat was granted time to obtain instructions, in view of the report annexure - SA-1 to the supplementary affidavit. 4. Instructions have been produced inter-alia indicating that action against respondent nos. 6 to 9 has been initiated under the Public Premises (Eviction of Unauthorized Occupants) Act, 1971 ('Act') and that after filing of the objection by respondent
