This petition has been filed by the petitioner seeking a direction to the authorities not to acquire land which is earmarked as graveyard, situated in Village Imlidiha, Pargana Maghar Purab, Tehsil Mehdawal, District Sant Kabir Nagar. 2. Submissions have been made that a notification dated 11.10.2024 has been issued under the National Highways Act, 1956 ('the Act') proposing to acquire land as indicated therein which includes the land of Qabristan and therefore, the respondents be directed not to acquire the land in question. 3. A perusal of the record indicates that in terms of provisions of Section 3C of the Act, objections to the acquisition can be made and after decision on the objections, a declaration under Section 3D is issued.
