Present criminal appeal arises from the judgment and order dated 12.11.1984 passed by Sri K.N. Singh Special Judge (DAA), Banda in Session Trial No.465 of 1980 State Vs Lalli, Piyare Lal, Baldeo Prasad and Badri. By that order learned trial court has convicted the appellants Baldeo and Piyare Lal, under Section 396 IPC, whereas, it has acquitted the accused persons Lalli and Badri for that offence. The appellants Baldeo and Piyare Lal are on bail. 2. The prosecution story emerged on the strength of a Written Report dated 10.6.1980 submitted by Raja Bhaiya (P.W.-1 at the trial) to the Police Station Karvi, Banda that in the intervening night of 9/10.6.1980, at that time the first informant was asleep along with his younger brother Raj Karan (in the courtyard), whereas his mother Lalita Devi, wife Sudhariya (P.W.-2 at the trial) and his sister-in-law Boota Devi (P.W.-3 a
