Heard leaned counsel for the petitioner through Video Conferencing, Sri Farhan Habib, learned counsel for the respondent and perused the record. 2. The present petition has been filed by the petitioner alleging that the respondent no. 2 is making encroachment and the respondent no. 1, who is bound to take action under the Waqf Act is not taking any action. 3.The counsel for the respondent no. 1 states that the action can be taken only in terms of the mandate contained in Rule 52 of the U.P. Waqf Rules 2024. 4. In view of the said statement, the present petition is disposed of permitting the petitioner to file an application. In case, the same is in compliance of Rule 52, the respondent no. 1 shall take action in accordance with law.
