Heard Sri Brijesh Kumar Srivastava, learned counsel for the applicant and Sri Sonu Kumar Upadhyay, learned Adovcate holding brief for Sri Harikesh Maurya, learned counsel for the informant as well as Sri R.P. Singh, learned State Law Officer and perused the material placed on record. 3. Applicant seeks bail in Case Crime No. 267 of 2023, U/S 363, 376(2)n IPC and 5L/6 of POCSO Act, 2012, Police Station Chiluwatal, District Gorakhpur, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case with a view to cause unnecessary harassment and to victimize him. It is stated that he has nothing to do with the said offence. 5. It is further stated that the victim is the consenting party, as is evident from her statement recorded u/s 164 Cr.P.C.
