Heard Sri Suresh Dhar Dwivedi, learned counsel for the applicant, Sri Jai Kishan Chaurasiya, learned State Law Officer as well as perused the material placed on record. 3. Applicant seeks bail in Case Crime No. 675 of 2024, under Section 70(1) BNS, Police Station Nigohi, District Shahjahanpur, during the pendency of trial. 4. Learned counsel for the applicant has argued that the applicant is absolutely innocent and has been falsely implicated in the present case. He has nothing to do with the said offence. It is further stated that the applicant is not named in the FIR. His name has come up later on in the statements of the victim recorded under sections 180 and 183 BNSS whereby she has stated that the applicant had gagged her mouth with his hand and the co-accused Sukhlal had raped her.
