Heard Sri Sunil Kumar Singh, learned counsel for the applicant and Sri Rajeev Dhar Dwivedi, learned AGA for the State- respondent. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 450 of 2024, under Sections 103(1), 352, 115(2) BNS, Police Station- Kotwali, District- Ballia, during pendency of the trial in the court below. 3. FIR of the present case was lodged on 13.09.2024 against applicant and his brother and according to FIR, on 13.09.2024 at about 9:30 a.m. in the morning due to family dispute, applicant along with his brother made assault upon his bhabhi due to which, she sustained injuries and died. 4. Learned counsel for the applicant submitted that on the basis of false allegation, only due to family dispute, applicant has been made accused in the present matter along with his brother. 5. He further submitted that however, from the FIR, it could not be
