Hon'ble Sameer Jain,J. 1. Heard Sri R.P. Mishra, learned counsel for the applicant appointed by High Court Legal Servises and Sri Vijay Bahadur Maurya, learned AGA for the State-respondent. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No. 122 of 2023, under Sections 302, 34 IPC, Police Station- Kotwali, District- Basti, during pendency of the trial in the court below. 3. Learned counsel for the applicant submitted that FIR of the present case was lodged against unknown person by the guard of the village and during investigation, on the basis of his confessional statement, applicant has been made accused in the present matter. 4. He further submitted that as per prosecution, deceased was having illicit relationship with the wife of the applicant, therefore, he committed his murder but except the bald and verbal allegation, there is no cogent evidence against the applicant in this reg
